Privacy Policy

Personal data is processed when using this website, registering for webinars and watching recorded webinars. On this page we inform you about these processing activities in accordance with the legal provisions of the General Data Protection Regulation (GDPR).

The responsible body for processing (“data controller”) is EVER Neuro Pharma GmbH, Oberburgau 3, 4866 Unterach, Austria (https://www.everpharma.com). Log of your visit to the website

When you access our website, information about the access (date, time, page viewed, amount of data, retrieving IP address) is stored as log files on our server. This is done on the legal basis of the legitimate interest in ensuring the smooth operation of our information offering and optimizing this offering (Art. 6 (1) f GDPR). This data is evaluated by us exclusively for our own statistical purposes, in an anonymous form. The log data will be deleted after one month.

In principle, your data will not be passed on to third parties. An exception is the transfer to data processors who work exclusively on instructions from EVER, who do not use the data for their own purposes and are bound by their own agreements to the data protection obligations of the General Data Protection Regulation.

Protection against cyber attacks

In order to protect our website against widespread cyber attacks, in particular distributed denial of service attacks (DDoS), we use the services of Cloudflare Inc., 101 Townsend St, San Francisco, CA 94107, USA (“Cloudflare”). The data transmitted between your device (browser) and our servers is checked for possible attack attempts and blocked if necessary. Information about this processing can be found at https://www.cloudflare.com/privacypolicy/.

This processing takes place on the basis of our legitimate interest in protecting our infrastructure and providing our information (Art. 6 (1) f GDPR). If, when using Cloudflare, data is transmitted to the USA and thus outside the European Union, this takes place on the legal basis of Art. 46 GDPR. For this purpose, the standard contractual clauses approved by the European Commission on June 4th, 2021 were concluded with Cloudflare.

Registration to participate in webinars

If you want to participate in our webinars, we process your name and contact information, which we use to send you the participation link. We use the information about the country for statistical purposes. All other information is voluntary and not required for registration. While participating in the webinar, technical information from your end device or your Internet connection will be processed to ensure optimal call quality.

The processing is necessary for the fulfillment of the agreement to participate in the webinar (Art. 6 (1) b GDPR). The data will be deleted after the webinar has taken place. You will not receive any e-mails from EVER apart from the information with the participation link.

Your data will be transmitted to the service provider Zoom Video Communications Inc, 55 Almaden Ave, Suite 600, San Jose, CA 95113, USA (“Zoom”) for sending the participation links and for conducting the webinar. We have concluded a data processing agreement with Zoom, so that Zoom is not allowed to use the data for its own purposes and is bound by the strict provisions of the General Data Protection Regulation. The transmission to the USA and thus to a country outside the European Union takes place on the basis of Art. 49 (1) b GDPR, according to which transmission is permissible if it is necessary for the performance of a contract between the data controller and the data subject.

Recording of webinars

In some of the webinars it is possible to ask questions. This can be done either with the chat function included in the Zoom application or as audio/video if the microphone or camera is activated. Since all webinars are recorded, your data will also be part of the recording in these cases. The processing takes place with your consent in accordance with Art. 6 (1) a GDPR and the transmission to countries outside the European Union on the basis of Art. 49 (1) a GDPR. Consent is voluntary, alternatively you can send your question by email and your name will not be mentioned in the webinar. You can revoke your consent at any time without giving reasons by sending an email to dpo@everpharma.com for future effect.

View recorded webinars

You can also view recordings of past webinars on this site. When viewing these recordings, data from your device and other technical connection information are transmitted to our service provider Vimeo Inc., 555 West 18th Street, New York, NY 10111, USA to ensure optimal picture and sound quality. This processing takes place on the basis of Art. 6 (1) b GDPR, as otherwise we cannot fulfill the agreement to watch recorded webinars and in accordance with Section 165 of the Austrian Telecommunications Act 2021, according to which transmissions are permitted if they are required for services expressly requested by the user. The transfer of the mentioned data to countries outside the European Union is permitted on the basis of Art. 49 (1) b GDPR, because the transfer is necessary to fulfill the agreement to access the webinar recording.

In addition to the data mentioned during the retrieval of the recording, we process statistical data such as the number of retrievals based on our legitimate interest in optimizing the content (Article 6 (1) f GDPR). This information will of course not be passed on to third parties.

Your rights

You have the right to access, rectification and erasure of data, the right to restrict processing, to object to processing (if processing is based on legitimate interest and you are in a particular situation), to data portability and the right to lodge a complaint with a supervisory authority.
